To start a California foreclosure, excluding 1st position Owner Occupied properties, submit this completed form along with a copy of the Note, Deed, any Assignments, and any Modifications. Also include a Substitution of Trustee (Form 7), the CA Declaration of Beneficiary/Lender (Form 9), and the CA Declaration of Mortgage Servicer (Form 10, only if FCI is not servicing the Loan). A deposit is required to start a foreclosure. Call extension 282 for an estimate of total foreclosure costs and the deposit amount.

The California Declaration of Beneficiary/Lender pursuant to California Civil Code Section 2923.5(b) or Section 2923.55(c), (Senate Bill SB 900 effective January 1, 2013) must be filled out and signed by the Beneficiary/Lender, or an authorized agent, and submitted with the Request to Start Foreclosure in CA. Do not submit this form if you are submitting a CA 1st position Owner Occupied note to Judicial Forclosure coordination.

The California Declaration of Mortgage Servicer pursuant to California Civil Code 2923.5(b) or Section 2923.55(c), (Senate Bill SB 900 effective January 1, 2013) must be filled out and signed by an authorized agent or employee of the Mortgage Servicer and submitted with the Request to Start Foreclosure in CA. A Lender who is self servicing (receiving borrower payments) is considered the Mortgage Servicer. Note: this form is not needed if FCI is already servicing the Loan. Do not submit this form if you are submitting a CA 1st position Owner Occupied note to Judicial Foreclosure coordination.
